Know the job before you judge it.

You can't fairly grade a leader on things their office was never meant to do. Here's what the President, the Governor, and your MP are actually responsible for under Kenya's Constitution โ€” so you can hold the right person to account for the right thing.

Why this matters. A lot of political frustration comes from blaming the wrong office. People judge an MP for bad county roads, or a Governor for national tax โ€” and the real decision-maker walks free. When you know who does what, your vote and your questions land where they actually count.

National government

The President

Constitution, Art. 131โ€“132

The President is Head of State and Head of Government โ€” the person who runs the national government and represents Kenya to the world.

โœ“ What the office does

  • โœ“Exercises national executive authority together with the Cabinet.
  • โœ“Is Commander-in-Chief of the Defence Forces and chairs the National Security Council.
  • โœ“Appoints (with approval) Cabinet Secretaries, the Attorney-General and Principal Secretaries.
  • โœ“Assents to or refers back Bills passed by Parliament.
  • โœ“Represents Kenya in national and international affairs.

โœ• What it doesn't control

  • โœ•Day-to-day county services โ€” that's devolved to Governors.
  • โœ•Making laws directly โ€” that's Parliament's job; the President assents.
  • โœ•Local ward and constituency projects.
  • โœ•Court decisions โ€” the Judiciary is independent.

  • ?What has been delivered on the national promises made last time โ€” and where's the evidence?
  • ?How has national revenue been raised and spent, and who benefited?

County government

The Governor

Constitution, Art. 179

The Governor is the chief executive of the county โ€” the person responsible for delivering the services that devolution moved closer to home.

  • โœ“Leads the county executive and appoints its members (with assembly approval).
  • โœ“Runs devolved services: county health, county roads, water, agriculture, markets.
  • โœ“Implements county laws and assents to Bills from the county assembly.
  • โœ“Submits county plans, policies and budgets, and reports on them.
  • โœ“Represents the county in national affairs.

  • โœ•National matters โ€” defence, foreign policy, national taxation.
  • โœ•National trunk roads and national referral hospitals.
  • โœ•Making national law โ€” that's Parliament.
  • โœ•Security and policing โ€” a national function.

The Member of Parliament

An MP is a lawmaker and a watchdog โ€” elected to make national laws, represent the constituency, and check how the national government spends public money.

  • โœ“Makes national laws โ€” debates, proposes and passes Bills.
  • โœ“Represents constituents and their concerns in the National Assembly.
  • โœ“Oversight: scrutinises national revenue and how the executive spends it.
  • โœ“Approves budgets, and can question and hold state organs to account.
  • โœ“Represents the people in decisions to allocate national revenue.

  • โœ•Running county services โ€” that's the Governor.
  • โœ•Being a project contractor โ€” an MP legislates and oversees, not builds.
  • โœ•Executive decisions โ€” that's the national or county executive.
  • โœ•Personal handouts as a substitute for lawmaking and oversight.

  • ?What laws has this MP sponsored or supported, and how have they affected the people who elected them?
  • ?How has the MP used their oversight role to check national spending?
  • ?How have constituency funds under their watch been used, and is there a public account?

Why three offices, three jobs?

Kenya's 2010 Constitution split power on purpose. National matters โ€” defence, foreign policy, national taxation โ€” sit with the national government. Services that work best closer to home โ€” county health, local roads, water โ€” were devolved to 47 counties. And lawmaking and oversight sit with elected representatives, separate from the people who run things. Knowing which box a problem falls into is the difference between frustration and accountability.
