Chapter 16 ยท Articles 255โ257
Amendment of This Constitution
- 255Amendment of this ConstitutionAmendments touching supremacy, territory, people's sovereignty, key national values, the Bill of Rights, the President's term, independence of the Judiciary and commissions, Parliament's functions, devolution or the amendment rules need a referendum: 20% turnout in half the counties and a simple majority.
- 256Amendment by parliamentary initiativeParliament can amend the Constitution if each House passes the Bill by at least two-thirds of all its members, after a ninety-day wait and public discussion. If it touches a matter listed in Article 255(1), a referendum is needed before the President assents.
- 257Amendment by popular initiativeA popular initiative signed by at least one million registered voters, verified by the IEBC, may propose an amendment. If most county assemblies approve, it goes to Parliament. If either House fails to pass it, or it concerns an Article 255(1) matter, a referendum follows.
