Ask the Constitution

Can the President dissolve Parliament?

It depends

Only in one situation: when Parliament fails to pass required laws after a court order, and the Chief Justice advises dissolution.

Article 102 says Parliament's term ends on the date of the next general election. The only dissolution provided for is in Article 261: if Parliament fails to enact required legislation after a High Court order, the Chief Justice shall advise the President to dissolve Parliament, and the President shall do so.

β€œthe Chief Justice shall advise the President to dissolve Parliament and the President shall dissolve Parliament.”

Article 261: Consequential legislation
